Algemene Voorwaarden

Door je in te schrijven voor een activiteit, opleiding of stage van KCH ga je akkoord met volgende voorwaarden:

1. Algemene Bepalingen, Inschrijving & Prijzen

  • Betaling: De betaling van het volledige inschrijvingsgeld dient onmiddellijk tijdens de inschrijving te gebeuren. Gebeurt dit niet, dan vervalt je voorlopige reservering en kan je plaats worden doorgegeven aan een andere deelnemer.
  • Uitsluiting herroepingsrecht: Overeenkomstig de wettelijke bepalingen rond vrijetijdsbesteding op een specifieke datum (art. VI.53, 12° WER), is het wettelijke herroepingsrecht van 14 dagen niet van toepassing. Een inschrijving is bindend en valt onder onze annuleringsvoorwaarden (zie artikel 6).
  • Prijzen: De prijs omvat enkel wat expliciet op de webpagina of infofiche van de activiteit staat vermeld. KCH behoudt zich het recht voor om onvoorziene, significante prijsstijgingen vanuit externe partners (zoals bv. brandstoftoeslagen of verhoogde taksen voor berghutten) op een transparante manier door te rekenen aan de deelnemer.
  • Kennelijke fouten: KCH is niet gebonden door kennelijke materiële vergissingen of overduidelijke typfouten in de communicatie of op de website (zoals een onrealistische prijs of een foute datum). 
  • Minderjarigen: Bij de inschrijving van een minderjarige deelnemer gaan de ouders of de wettelijke voogd automatisch akkoord met deze voorwaarden en dragen zij de eindverantwoordelijkheid.
  • Voorwaarden per activiteit: Voor sommige activiteiten is een bepaald klimniveau of een klimvaardigheidsbewijs (KVB) vereist. Dit staat steeds bij de activiteit vermeld. Voldoe je hier niet aan, dan kan de begeleiding overgaan tot uitsluiting zonder terugbetaling van de deelnamesom.
  • Weigeringsrecht: KCH behoudt zich het recht voor om inschrijvingen op voorhand te weigeren indien eerdere ervaringen of gedrag van de deelnemer de veiligheid of de goede werking van de groep in het gedrang kunnen brengen, of indien de deelnemer niet voldoet aan de deelnamevoorwaarden. 
  • Aanvullende reglementen: Voor specifieke afdelingen (zoals het competitieteam of de jeugdwerking) of activiteiten kunnen aanvullende huishoudelijke reglementen of selectiecriteria gelden. Bij deelname aan deze werkingen of activiteiten gelden deze regels aanvullend op deze algemene voorwaarden. 
  • Intellectueel eigendom: Al het ter beschikking gestelde lesmateriaal (zoals bv. syllabi, oefenschema’s of presentaties) blijft intellectueel eigendom van KCH of haar lesgevers. Dit materiaal mag niet zonder uitdrukkelijke schriftelijke toestemming worden vermenigvuldigd, gedeeld met derden of voor commerciële doeleinden worden gebruikt. 

2. Veiligheid, Medische Geschiktheid & Gedrag

  • Risico’s: KCH stelt alles in het werk om activiteiten veilig te laten verlopen. Klim- en bergsporten houden echter altijd een inherent risico in. Je aanvaardt dit risico en volgt steeds de richtlijnen van de begeleiders.
  • Medische en mentale conditie: Je verklaart dat je over de nodige fysieke en mentale conditie beschikt voor de activiteit. Je mag geen medische of mentale problemen verzwijgen die je eigen veiligheid of die van de groep in gevaar kunnen brengen.
  • Alcohol en drugs: Er is een absolute nultolerantie voor het gebruik van alcohol en drugs voor en tijdens de clubactiviteiten.
  • Natuur: We verwachten dat deelnemers de natuur respecteren (geen afval achterlaten, niet roken aan de massieven) en de lokale regels van de klimmassieven en leslocaties strikt opvolgen.
  • Uitsluiting: Het niet naleven van instructies of deze gedragsregels kan leiden tot onmiddellijke uitsluiting van de activiteit, zonder recht op terugbetaling.
  • Vrij klimmen: Bij activiteiten die als ‘vrij klimmen’ (zonder formele instructie of begeleiding) worden georganiseerd, klimmen de deelnemers volledig autonoom en op eigen verantwoordelijkheid. KCH treedt hierbij enkel op als logistieke organisator van de activiteit. 

3. Materiaal & Persoonlijke Bezittingen

  • Clubmateriaal: Je behandelt het materiaal van de club met respect. Bij verlies, diefstal of opzettelijke schade kan de kostprijs op jou (of de groep) verhaald worden.
  • Eigen materiaal & uitrusting: Wie eigen klimmateriaal gebruikt, is zelf verantwoordelijk voor de goede en veilige staat ervan. Deelnemers zijn verplicht de gecommuniceerde ‘materiaallijst’ te respecteren. Bij het ontbreken van essentieel veiligheidsmateriaal kan de begeleiding deelname weigeren zonder recht op terugbetaling. De organisatie kan materiaal weigeren bij twijfel over de veiligheid.
  • Persoonlijke bezittingen: KCH is niet aansprakelijk voor verlies, diefstal of beschadiging van persoonlijke spullen (zoals gsm, kleding, brillen, eigen klimmateriaal of andere) tijdens de activiteiten.

4. Vervoer, Carpoolen & Verzekering

  • Verzekering & Bergsport: Lidmaatschap bij de Klim- en Bergsportfederatie (KBF) is sterk aangeraden vanwege de bergsportverzekering en is verplicht bij outdoor activiteiten of opleidingen zoals bv. KVB2+ of KVB3. Voor het deelnemen aan activiteiten is de deelnemer verplicht over een verzekering te beschikken afgenomen bij een klim- en bergsport federatie. De deelnemer geeft tijdens de inschrijving het lidnummer door. In het geval er geen geldig lidnummer opgegeven is, behoudt KCH het recht om de deelnemer uit te sluiten van de activiteit zonder recht op terugbetaling.
  • Schade aan derden: Je bent zelf verantwoordelijk voor eventuele schade die je (al dan niet per ongeluk) toebrengt aan derden of hun eigendommen. Een familiale verzekering (Burgerlijke Aansprakelijkheid / BA-privéleven) wordt sterk aangeraden.
  • Reddings- en medische kosten: Eventuele kosten voor medische bijstand, bergevacuatie (zoals een helikopterredding) of repatriëring zijn steeds en uitsluitend ten laste van de deelnemer of diens persoonlijke (bergsport)verzekering. KCH kan hiervoor in geen enkel geval financieel aansprakelijk worden gesteld. 
  • Vervoer en carpoolen: Vervoer van en naar de activiteiten (inclusief carpoolen) is steeds op eigen verantwoordelijkheid en eigen risico. De bestuurder is zelf verantwoordelijk voor een geldige autoverzekering en de naleving van de verkeersregels.
  • Gebruik van een carpool-app: Wanneer KCH een platform of app ter beschikking stelt om carpoolen te vergemakkelijken, fungeert de club louter als facilitator. KCH is in geen geval aansprakelijk voor de praktische afspraken, eventuele ongevallen, schade of geschillen die voortvloeien uit dit vervoer.

5. Annulatie, Wijziging of Overmacht door KCH

  • Wijzigingen: Het programma, de locatie of de uren kunnen door de organisatie worden aangepast (bijvoorbeeld door slechte weersomstandigheden of het niveau van de groep). Indien een buitenactiviteit hierdoor noodgedwongen verplaatst wordt naar een indoor klimzaal, is de toegangsprijs voor de zaal ten laste van de deelnemer. 
  • Annulatie: KCH kan een activiteit annuleren of uitstellen (bv. bij onvoldoende inschrijvingen of extreem slecht weer). Bij annulatie door KCH betalen we de deelnamesom (of, indien de activiteit reeds van start ging, het geannuleerde deel) volledig terug.
  • Overmacht: Bij onvoorziene externe factoren (zoals een pandemie, algemene stakingen of de onverwachte sluiting van een klimmassief of klimzaal) kan KCH de activiteit wijzigen of annuleren. KCH is in dat geval niet aansprakelijk voor de extra kosten die de deelnemer zelf al maakte (zoals vooraf geboekte vluchten, huurwagens of andere transportmiddelen).

6. Annulatie door de Deelnemer
Omdat KCH voor activiteiten en stages vaak op voorhand onkosten maakt, hanteren we onderstaande annuleringsregels.
We raden deelnemers sterk aan om zelf een externe annulatieverzekering af te sluiten.
Elke annulatie of indienen van een medisch attest dient schriftelijk te gebeuren via info@klimclubhungaria.be.

  • Voor eendaagse of lokale activiteiten:
    • Annuleren kan kosteloos tot de uiterste inschrijvingsdatum (of tot uiterlijk 14 kalenderdagen voor de start indien er geen datum is gecommuniceerd), minus een administratiekost van 10% van de deelnamesom (met een minimum van €5 en een maximum van €25). 
    • Na deze termijn is er geen terugbetaling mogelijk, tenzij om medische of dwingende redenen (zie onder). 
  • Voor meerdaagse en buitenlandse stages:
    • Tot 60 dagen voor de start van het voorbereidingsmoment (of de startdatum van de stage indien er geen voorbereidingsmoment plaatsvindt): Terugbetaling van de deelnamesom, minus een administratiekost van 10% van de deelnamesom (met een minimum van €5 en een maximum van €25).
    • Tussen 59 en 30 dagen voor de start van het voorbereidingsmoment (of de startdatum van de stage indien er geen voorbereidingsmoment plaatsvindt): 50% van de deelnamesom wordt ingehouden.
    • Minder dan 30 dagen voor de start van het voorbereidingsmoment (of de startdatum van de stage indien er geen voorbereidingsmoment plaatsvindt): 85% van de deelnamesom wordt ingehouden. 
  • Medische en dwingende redenen: Bij een tijdig ingediend doktersattest wegens ziekte/blessure betalen we het bedrag terug (eventueel pro rata). Ook bij het overlijden van een naaste (tot de 2e graad) of zware materiële schade aan de woning (waarbij tussenkomst van een verzekering/instantie vereist is) storten we de deelnamesom terug. 
  • Andere redenen: Voor overige redenen (bv. extra werk, herexamens) is er geen recht op terugbetaling buiten de vaste termijnen. Bij uitzonderlijke overmacht beslist het bestuur hier kritisch over per individueel geval.

7. Privacy

  • Voor de manier waarop wij omgaan met jouw persoonsgegevens en het gebruik van beeldmateriaal tijdens onze activiteiten, verwijzen we naar de uitgebreide privacyverklaring op onze website. Door akkoord te gaan met deze algemene voorwaarden, stem je ook in met die verklaring.
  • Tijdelijke communicatiekanalen: Voor de logistieke organisatie van activiteiten (zoals carpoolen) kunnen tijdelijke communicatiekanalen (zoals bv. WhatsApp-groepen) worden opgericht. Deze dienen uitsluitend voor praktische afspraken. Zowel deelnemers als lesgevers gaan respectvol met elkaar om. Het is noch de deelnemers, noch de lesgevers toegestaan om elkaars contactgegevens voor enige andere (commerciële of privé) doeleinden te gebruiken. 

8. Bijzondere Voorwaarden voor Stages en Kampen
Wanneer een lid zich inschrijft voor een meerdaagse stage, (rots)klimkamp of buitenactiviteit georganiseerd door KCH, gelden in aanvulling op de standaardvoorwaarden de volgende specifieke bepalingen:

  • Instapvoorwaarden en KVB: Voor bepaalde stages is een specifiek klimniveau of het bezit van een Klimvaardigheidsbewijs (KVB) verplicht. Dit wordt steeds expliciet vermeld in de infofiche of stagebeschrijving. KCH behoudt zich het recht voor om deelnemers die niet aan deze voorwaarden voldoen, (ook ter plaatse) uit te sluiten van deelname om de veiligheid te garanderen.
  • Kostenverdeling ter plaatse: Het inschrijvingsgeld omvat uitsluitend de stagebegeleiding en de voorzieningen zoals expliciet vermeld in de beschrijving. Uitsluitend indien dit vooraf in de stagebeschrijving vermeld staat, worden overige kosten (zoals verblijfs- of reiskosten van de begeleider) ter plaatse gedeeld door de deelnemers. Voor de praktische verrekening hiervan kan gebruikgemaakt worden van applicaties zoals Splitwise en Bancontact. 
  • Programmawijzigingen en Overmacht: KCH en de betrokken sportbegeleiders hebben te allen tijde het recht om het programma, de locatie of de eindtijd van de stage aan te passen in functie van weersomstandigheden, veiligheid of het niveau van de deelnemers. Een stage kan in uitzonderlijke gevallen door de organisatie vroegtijdig worden afgebroken. Dergelijke noodzakelijke wijzigingen geven geen recht op (gedeeltelijke) terugbetaling of schadevergoeding.
  • Restrisico: De club stelt alles in het werk om de stage op een veilige manier te laten verlopen. De deelnemer erkent echter dat de beoefening van klim- en bergsporten in de vrije natuur een inherent restrisico inhoudt dat nooit volledig uitgesloten kan worden. De deelnemer aanvaardt dit restrisico onvoorwaardelijk.

9.  Aansprakelijkheid, Klachten, Recht & Geldigheid

Wijzigingen: KCH behoudt zich het recht voor om deze algemene voorwaarden aan te passen. Bij inschrijving is steeds de versie van toepassing die op dat moment geldig was op de website.

Aansprakelijkheid: Behalve in het geval van opzet of een zware fout van de club zelf, is de aansprakelijkheid van KCH steeds beperkt tot het bedrag dat door de verzekering wordt gedekt.

Klachten: Klachten over de organisatie van een activiteit of stage dienen schriftelijk gemeld te worden via info@klimclubhungaria.be, uiterlijk 14 dagen na afloop van de activiteit.

Toepasselijk Recht: Op deze voorwaarden is uitsluitend het Belgisch recht van toepassing. Bij eventuele geschillen zijn enkel de rechtbanken van het arrondissement waar de maatschappelijke zetel van de club gevestigd is bevoegd.

Splitsbaarheid: Indien een bepaling van deze algemene voorwaarden ongeldig of niet-afdwingbaar zou worden verklaard, heeft dit geen invloed op de geldigheid van de overige bepalingen.

Taal van de voorwaarden: Deze algemene voorwaarden werden oorspronkelijk opgesteld in het Nederlands. Bij eventuele interpretatieverschillen of discussies tussen de Nederlandstalige tekst en vertalingen daarvan, krijgt de originele Nederlandstalige tekst steeds voorrang.

By registering for an activity, training course, or stage of KCH, you agree to these terms and conditions:

1. General Provisions, Registration & Prices

  • Payment: The payment of the full registration fee must be made immediately upon registration. Failure to do so will result in the expiration of your provisional reservation, and your spot may be passed on to another participant.
  • No Right of Withdrawal: In accordance with the legal provisions regarding leisure activities scheduled on a specific date (Art. VI.53, 12° of the Belgian Code of Economic Law – WER), the statutory 14-day right of withdrawal does not apply. A registration is binding and falls under our cancellation policy (see Article 6).
  • Prices: The price only includes what is explicitly stated on the webpage or info sheet of the activity. KCH reserves the right to pass on unforeseen, significant price increases from external partners (e.g., fuel surcharges or increased taxes for mountain huts) to the participant in a transparent manner.
  • Obvious errors: KCH is not bound by obvious material errors or evident typos in communication or on the website (such as an unrealistic price or incorrect date).
  • Minors: When registering a minor participant, the parents or legal guardians automatically agree to these terms and conditions and bear ultimate responsibility.
  • Activity Requirements: Some activities require a specific climbing level or climbing proficiency certificate (KVB). This is always stated with the activity description. If you do not meet this requirement, the guides may proceed to exclude you without a refund of the participation fee.
  • Right of Refusal: KCH reserves the right to refuse registrations in advance if previous experiences or the participant’s behavior may compromise the safety or the proper functioning of the group, or if the participant does not meet the participation requirements.
  • Additional regulations: Specific departments (such as the competition team or youth department) or activities may be subject to additional internal regulations or selection criteria. When participating in these programs or activities, these rules apply in addition to these general terms and conditions.
  • Intellectual property: All provided course materials (e.g., syllabi, training schedules, or presentations) remain the intellectual property of KCH or its instructors. This material may not be reproduced, shared with third parties, or used for commercial purposes without explicit written permission.

2. Safety, Medical Fitness & Behavior

  • Risks: KCH makes every effort to ensure activities run safely. However, climbing and mountaineering always involve an inherent risk. You accept this risk and must always follow the guidelines of the guides/instructors.
  • Medical and Mental Fitness: You declare that you possess the necessary physical and mental fitness for the activity. You may not conceal any medical or mental issues that could endanger your own safety or that of the group.
  • Alcohol and Drugs: There is an absolute zero-tolerance policy for the use of alcohol and drugs before and during club activities.
  • Nature: We expect participants to respect nature (leave no trace/do not leave trash, no smoking at the crags) and strictly follow the local rules of the climbing areas and training locations.
  • Exclusion: Failure to comply with instructions or these behavioral rules may lead to immediate exclusion from the activity, without the right to a refund.
  • Independent climbing: During activities organized as ‘independent climbing’ (without formal instruction or guidance), participants climb entirely autonomously and at their own risk. In these cases, KCH acts solely as the logistical organizer of the activity.

3. Equipment & Personal Belongings

  • Club Equipment: You must treat the club’s equipment with respect. In the event of loss, theft, or deliberate damage, the cost may be recovered from you (or the group).
  • Personal Equipment & Gear: Those using their own climbing equipment are solely responsible for its good and safe condition. Participants are required to respect the communicated ‘equipment list’. If essential safety equipment is missing, the guides may refuse participation without the right to a refund. The organization may refuse equipment if there are doubts about its safety.
  • Personal Belongings: KCH is not liable for loss, theft, or damage to personal items (such as mobile phones, clothing, glasses, personal climbing gear, or other items) during the activities.

4. Transport, Carpooling & Insurance

  • Insurance & Mountaineering: Membership with the Climbing and Mountaineering Federation (KBF) is strongly recommended for its mountaineering insurance and is mandatory for outdoor activities or training courses e.g., KVB2+ or KVB3. To participate in activities, the participant is required to have an insurance policy taken out with a climbing and mountaineering federation. The participant must provide their membership number during registration. If no valid membership number is provided, KCH reserves the right to exclude the participant from the activity without the right to a refund.
  • Damage to Third Parties: You are personally responsible for any damage you cause (whether accidentally or not) to third parties or their property. Personal liability insurance (Family Insurance / BA-privéleven) is strongly recommended.
  • Rescue and medical costs: Any costs for medical assistance, mountain evacuation (such as a helicopter rescue), or repatriation are always and exclusively the responsibility of the participant or their personal (mountaineering) insurance. Under no circumstances can KCH be held financially liable for these costs.
  • Transport and Carpooling: Transport to and from activities (including carpooling) is always at your own responsibility and your own risk. The driver is personally responsible for valid car insurance and compliance with traffic rules.
  • Use of a Carpool App: If KCH provides a platform or app to facilitate carpooling, the club acts solely as a facilitator. KCH is under no circumstances liable for practical arrangements, potential accidents, damage, or disputes arising from this transport.

5. Cancellation, Modification or Force Majeure by KCH

  • Modifications: The program, location, or schedule may be adjusted by the organization (e.g., due to poor weather conditions or the level of the group). If an outdoor activity is forced to relocate to an indoor climbing gym as a result, the gym entrance fee is at the expense of the participant.
  • Cancellation: KCH may cancel or postpone an activity (e.g., due to insufficient registrations or extremely bad weather). In the event of cancellation by KCH, we will fully refund the participation fee (or, if the activity had already started, the canceled portion).
  • Force Majeure: In the event of unforeseen external factors (such as a pandemic, general strikes, or the unexpected closure of a climbing area or climbing gym), KCH may modify or cancel the activity. In that case, KCH is not liable for the additional costs the participant has already incurred themselves (such as pre-booked flights, rental cars, or other means of transport).

6. Cancellation by the Participant Because KCH often incurs expenses in advance for activities and stages, we apply the following cancellation rules. We strongly advise participants to take out their own external cancellation insurance. Any cancellation or submission of a medical certificate must be done in writing via info@klimclubhungaria.be.

  • For one-day or local activities:
    • Cancellation is free of charge up to the registration deadline (or no later than 14 calendar days before the start if no date has been communicated), minus an administrative fee of 10% of the participation fee (with a minimum of €5 and a maximum of €25).
    • After this period, no refund is possible, except for medical or compelling reasons (see below).
  • For multi-day and foreign stages:
    • Up to 60 days before the start of the preparation moment (or the start date of the stage if no preparation moment takes place): Refund of the participation fee, minus an administrative fee of 10% of the participation fee (with a minimum of €5 and a maximum of €25).
    • Between 59 and 30 days before the start of the preparation moment (or the start date of the stage if no preparation moment takes place): 50% of the participation fee is retained.
    • Less than 30 days before the start of the preparation moment (or the start date of the stage if no preparation moment takes place): 85% of the participation fee is retained.
  • Medical and compelling reasons: Upon timely submission of a medical certificate due to illness/injury, we will refund the amount (possibly pro rata). We will also refund the participation fee in the event of the death of a close relative (up to the 2nd degree) or severe material damage to the home (requiring the intervention of an insurance company or official authority).
  • Other reasons: For other reasons (e.g., extra work, resits), there is no right to a refund outside the fixed timeframes. In cases of exceptional force majeure, the board will assess this critically on a case-by-case basis.

7. Privacy

  • Privacy Policy: For how we handle your personal data and the use of image material during our activities, we refer to the comprehensive privacy statement on our website. By agreeing to these general terms and conditions, you also consent to that statement.
  • Temporary communication channels: Temporary communication channels (e.g., WhatsApp groups) may be set up for the logistical organization of activities (e.g., carpooling). These are strictly for practical arrangements. Both participants and instructors must treat each other with respect. Neither participants nor instructors are permitted to use each other’s contact details for any other (commercial or private) purposes.

8. Special Conditions for Stages and Camps
When a member registers for a multi-day stage, (rock) climbing camp, or outdoor activity organized by KCH, the following specific provisions apply in addition to the standard terms and conditions:

  • Entry Requirements and KVB: For certain stages, a specific climbing level or possession of a Climbing Proficiency Certificate (KVB) is mandatory. This is always explicitly stated in the info sheet or stage description. KCH reserves the right to exclude participants who do not meet these conditions (even on location) to ensure safety.
  • Cost Sharing on Location: The registration fee strictly covers the stage guidance and the facilities explicitly mentioned in the description. Only if explicitly stated in the stage description in advance, will other costs (such as the guide’s accommodation or travel expenses) be shared among the participants on-site. Applications such as Splitwise and Payconiq may be used for the practical settlement of these costs. 
  • Program Modifications and Force Majeure: KCH and the involved sports guides reserve the right at all times to adjust the program, location, or end time of the stage based on weather conditions, safety, or the level of the participants. In exceptional cases, a stage may be terminated early by the organization. Such necessary changes do not entitle the participant to a (partial) refund or compensation.
  • Residual Risk: The club makes every effort to ensure the stage proceeds safely. However, the participant acknowledges that practicing climbing and mountaineering in the outdoors involves an inherent residual risk that can never be completely excluded. The participant unconditionally accepts this residual risk.

9. Liability, Complaints, Law & Validity

  • Liability: Except in the case of intent or gross negligence by the club itself, the liability of KCH is always limited to the amount covered by the insurance.
  • Complaints: Complaints regarding the organization of an activity or stage must be reported in writing via info@klimclubhungaria.be, no later than 14 days after the activity concludes.
  • Integrity Contact Point (API): api@klimclubhungaria.be
  • Applicable Law: These terms and conditions are governed exclusively by Belgian law. In the event of disputes, only the courts of the district where the club’s registered office is located shall have jurisdiction.
  • Severability: If any provision of these general terms and conditions is declared invalid or unenforceable, this will not affect the validity of the remaining provisions.
