1. Algemeen

  • Toepassingsgebied: Dit intern reglement preciseert de algemene regels voor de goede werking van de club. Het is van toepassing in onverbrekelijke samenhang met de recentste versie van de statuten van de vereniging. In geval van discrepantie tussen statuten en intern reglement, hebben de statuten steeds voorrang.
  • Kennisname en akkoord: Ieder lid wordt geacht kennis te hebben genomen van dit intern reglement en zal zich houden aan de bepalingen ervan. Door de aansluiting aanvaarden alle leden de reglementen en gedragscodes van de club en van de sportfederatie (Klim- en Bergsportfederatie / KBF), met inbegrip van het tuchtreglement.

2. Leden en gedragscode

  • Soorten leden: De vereniging bestaat, zoals in de statuten bepaald, uit werkende leden (die deel uitmaken van de algemene vergadering) en toegetreden leden (die actief aan sport doen in de vereniging en het lidgeld betalen).
  • Verplichtingen: Ieder lid verbindt zich ertoe om de statuten, het intern reglement, de algemene voorwaarden, de specifieke gedragscodes (als onderdeel van het clubcharter) en alle andere richtlijnen van de vereniging na te leven.
  • Gedrag: Ieder lid vertoont steeds onberispelijk, verantwoord en sportief gedrag. Kwetsende of onsportieve uitlatingen, of handelingen die de morele, fysieke of psychische integriteit van sporters of betrokkenen in het gedrang brengen, zijn ten strengste verboden.
  • Klachten en inspraak: Ieder lid kan klachten, wensen of voorstellen indienen bij het bestuur. Het bestuur engageert zich ertoe om hierbinnen een redelijke termijn op te antwoorden.

3. Lidmaatschap & bijdragen

  • Inschrijving en verzekering: Inschrijving bij de club gebeurt digitaal via de website en is pas definitief na volledige betaling van de verschuldigde bijdrage. Bij inschrijving aanvaardt het lid dat de nodige gegevens worden doorgegeven aan de KBF voor de verplichte verzekering voor burgerlijke aansprakelijkheid en lichamelijke ongevallen.
  • Lidgeld: De jaarlijkse bijdrage van de leden wordt bepaald door het bestuursorgaan. Deze bijdrage omvat de administratieve aansluiting, de toegang tot het reguliere sportaanbod (volgens de inschrijving) en het gebruik van clubmateriaal tijdens de lessen.
  • Geen terugbetaling: Het lidmaatschap of de jaarlijkse ledenbijdrage wordt in geen enkel geval terugbetaald bij vroegtijdige beëindiging of overmacht. Voor stages of kortdurende activiteiten gelden de annuleringsregels uit de Algemene Voorwaarden.

4. Structuur van de club

  • Organen: De structuur van de club bestaat uit de algemene vergadering, het bestuursorgaan (Raad van Bestuur) en het dagelijks bestuur dat wordt waargenomen door het kernteam en de verschillende werkgroepen (zoals Jeugd, Competitie en Volwassenen).
  • Aanspreekpunt integriteit (API): De club heeft een onafhankelijk API aangesteld voor meldingen rond grensoverschrijdend gedrag of integriteit, in alle vertrouwen te bereiken via api@klimclubhungaria.be.

5. Veilig en Ethisch Verantwoord Sporten

  • Integriteit: Er wordt gestreefd naar een vereniging zonder discriminatie, agressie, pesten en/of (seksueel) grensoverschrijdend gedrag. Het tuchtreglement inzake grensoverschrijdend gedrag van de KBF is onverkort van toepassing.
  • Alcohol en drugs: Er wordt op een gezonde en medisch verantwoorde manier aan sport gedaan. Er geldt een absolute nultolerantie voor alcohol en drugs voor en tijdens de sportieve activiteiten.
  • Clubcharter en gedragscodes: De club hanteert een overkoepelend Clubcharter met aparte, specifieke gedragscodes op maat van elke doelgroep (zoals een gedragscode voor sporters, voor ouders en voor sportbegeleiders). Deze documenten zijn steeds te raadplegen op de website. Iedereen die betrokken is bij de club dient de voor hem of haar relevante gedragscode strikt te respecteren.

6. Tucht en sancties

  • Procedures: Wanneer een lid de reglementen schendt of zich ongepast gedraagt, kan een klacht aanhangig gemaakt worden conform de tuchtprocedure van de KBF.
  • Sancties: Het bestuur kan preventieve ordemaatregelen nemen (bv. een tijdelijke schorsing). Zware inbreuken op de integriteit of veiligheid worden gesanctioneerd met de onmiddellijke ontbinding van het lidmaatschap, eventueel met eis tot schadevergoeding. De club behoudt zich het recht voor om sancties bekend te maken aan andere sportclubs of federaties ter bescherming van de sport.

7. Sportspecifieke regels en interne werking

  • Veiligheid en noodprotocol: Leden dienen bij incidenten of ongevallen altijd de richtlijnen van het interne Nood- en Ongevallenprotocol van KCH te volgen.
  • Materiaalbeheer: Voor het lenen van clubmateriaal wordt gebruikgemaakt van het digitale registratiesysteem (Shelf.nu). De communicatie en procedures hieromtrent dienen strikt gerespecteerd te worden.
  • Infrastructuur: De vereniging is te gast in externe infrastructuur (zoals klimzaal De Stordeur). Leden zijn verplicht de specifieke huisregels en de geldende afspraken tussen de klimzaal en de club te allen tijde te respecteren.
  • Ecologie: Bij buitenklimmen hanteren we een strikte ecologische code: geen afval, respect voor natuur en strikte naleving van de lokale (rots)reglementen.

8. Vrijwilligers en sportbegeleiders

  • Overeenkomsten: De club steunt voor haar werking op een team van geëngageerde vrijwilligers en sportbegeleiders. Voor hen gelden specifieke rechten en plichten die worden vastgelegd in een afzonderlijke, persoonlijke vrijwilligersovereenkomst, de specifieke gedragscode voor sportbegeleiders en in de interne medewerkersrichtlijnen.
  • Strafregister: KCH hecht enorm veel belang aan de veiligheid en integriteit van haar leden. Elke begeleider die op structurele basis met minderjarigen werkt, is wettelijk verplicht om voorafgaand aan de aanstelling een uittreksel uit het strafregister (model 596-2) voor te leggen.

9. Sponsoring

  • Sponsorafspraken: De club kan contracten met sponsors aangaan. Tijdens competities of clubactiviteiten kan aan leden gevraagd worden om clubkledij te dragen waarop het logo van de sponsor(s) is afgebeeld.

10. Aansprakelijkheid

  • Ongevallen: In geval van een ongeval deelt het lid dit zo snel mogelijk mee aan de verantwoordelijke. Indien gedekt door de verzekering (KBF), volgt een aangifte. Voor medische bijstand of bergevacuatie (zoals een helikopterredding) draait het lid of diens persoonlijke verzekering uitsluitend zelf op.
  • Eigendommen: De vereniging is in geen geval aansprakelijk voor diefstal, verlies of beschadiging van persoonlijke bezittingen van de leden.

11. Privacy en gegevensverwerking

  • Privacyverklaring: De persoonsgegevens van leden worden behandeld overeenkomstig de privacyverklaring van de club.
  • Geheimhouding: Leden, vrijwilligers en medewerkers die uit hoofde van hun functie toegang krijgen tot persoonsgegevens van andere leden, zijn gehouden aan een strikte geheimhoudingsplicht. Zij mogen deze gegevens enkel gebruiken voor het afgesproken doel en moeten deze veilig bewaren.
  • Beeldmateriaal: Elk lid stemt ermee in dat tijdens activiteiten foto’s en beeldopnames gemaakt kunnen worden voor clubkanalen, tenzij hiertegen vooraf uitdrukkelijk en gemotiveerd verzet wordt aangetekend.

12. Wijziging van het intern reglement

  • Taal: Dit reglement werd oorspronkelijk opgesteld in het Nederlands. Bij eventuele interpretatieverschillen tussen de Nederlandstalige tekst en vertalingen daarvan, krijgt de Nederlandstalige tekst steeds voorrang.
  • Aanpassingen: Dit intern reglement kan enkel gewijzigd worden op de wijze zoals in de statuten van de vereniging bepaald (door een besluit van het bestuur). Bij inschrijving is steeds de versie van toepassing die op dat moment geldig is op de website.

1. General

  • Scope: These internal regulations detail the general rules for the proper functioning of the club. They apply in inseparable connection with the latest version of the association’s statutes. In the event of a discrepancy between the statutes and the internal regulations, the statutes shall always prevail.
  • Acknowledgment and agreement: Every member is deemed to have taken note of these internal regulations and will comply with their provisions. By joining the club, all members accept the regulations and codes of conduct of the club and the sports federation (Climbing and Mountaineering Federation / KBF), including the disciplinary regulations.

2. Members and Code of Conduct

  • Types of members: As stipulated in the statutes, the association consists of working members (who are part of the general assembly) and joined members (who actively participate in sports in the association and pay the membership fee).
  • Obligations: Every member commits to strictly observing the statutes, the internal regulations, the general terms and conditions, the specific codes of conduct (as part of the club charter), and all other guidelines of the association.
  • Behavior: Every member must always exhibit impeccable, responsible, and sportsmanlike behavior. Hurtful or unsportsmanlike remarks, or actions that compromise the moral, physical, or psychological integrity of athletes or those involved, are strictly prohibited.
  • Complaints and suggestions: Every member can submit complaints, requests, or proposals to the board. The board commits to responding within a reasonable timeframe.

3. Membership & Fees

  • Registration and insurance: Registration with the club is done digitally via the website and is only final after full payment of the due fee. Upon registration, the member accepts that the necessary data will be passed on to the KBF for the mandatory insurance for civil liability and physical accidents.
  • Membership fee: The annual membership fee is determined by the board of directors. This fee covers the administrative affiliation, access to the regular sports offerings (according to the registration), and the use of club equipment during classes.
  • No refund: The membership or the annual membership fee will under no circumstances be refunded in the event of early termination or force majeure. For stages or short-term activities, the cancellation rules from the General Terms and Conditions apply.

4. Structure of the Club

  • Bodies: The structure of the club consists of the general assembly, the board of directors, and the daily management carried out by the core team and the various working groups (such as Youth, Competition, and Adults).
  • Integrity Contact Point (API): The club has appointed an independent API for confidential reports regarding transgressive behavior or integrity, reachable at api@klimclubhungaria.be.

5. Safe and Ethically Responsible Sports

  • Integrity: We strive for an association free from discrimination, aggression, bullying, and/or (sexual) transgressive behavior. The KBF disciplinary regulations regarding transgressive behavior apply in full.
  • Alcohol and drugs: Sports are practiced in a healthy and medically responsible manner. There is an absolute zero-tolerance policy for alcohol and drugs before and during sporting activities.
  • Club charter and Codes of Conduct: The club utilizes an overarching Club Charter containing separate, specific codes of conduct tailored to each target group (such as a code of conduct for athletes, for parents, and for sports guides). These documents are always available on the website. Everyone involved with the club must strictly respect the code of conduct relevant to them.

6. Discipline and Sanctions

  • Procedures: When a member violates the regulations or behaves inappropriately, a complaint can be filed in accordance with the disciplinary procedure of the KBF.
  • Sanctions: The board may take preventive order measures (e.g., a temporary suspension). Severe violations of integrity or safety will be sanctioned with the immediate termination of the membership, possibly with a claim for damages. The club reserves the right to disclose sanctions to other sports clubs or federations to protect the sport.

7. Sport-Specific Rules and Internal Operations

  • Safety and Emergency Protocol: In the event of incidents or accidents, members must always follow the guidelines of the internal Emergency and Accident Protocol of KCH.
  • Equipment management: A digital registration system (Shelf.nu) is used for borrowing club equipment. The communication and procedures regarding this must be strictly respected.
  • Infrastructure: The association is a guest in external infrastructure (such as climbing gym De Stordeur). Members are obliged to respect the specific house rules and the current agreements between the climbing gym and the club at all times.
  • Ecology: When climbing outdoors, we apply a strict ecological code: leave no trace/waste, respect nature, and strictly comply with local (crag) regulations.

8. Volunteers and Sports Guides

  • Agreements: The club relies on a team of committed volunteers and sports guides for its operations. Specific rights and obligations apply to them, which are laid down in a separate, personal volunteer agreement, the specific code of conduct for sports guides, and in the internal staff guidelines.
  • Criminal record: KCH attaches great importance to the safety and integrity of its members. Every guide who works directly with minors on a structural basis is legally obliged to submit a criminal record extract (model 596-2) prior to their appointment.

9. Sponsorship

  • Sponsor agreements: The club may enter into contracts with sponsors. During competitions or club activities, members may be asked to wear club clothing bearing the logo(s) of the sponsor(s).

10. Liability

  • Accidents: In the event of an accident, the member must report this to the responsible person as soon as possible. If covered by the insurance (KBF), a declaration will follow. The member or their personal insurance is exclusively responsible for medical assistance or mountain evacuation (such as a helicopter rescue).
  • Properties: The association is under no circumstances liable for theft, loss, or damage to the personal belongings of the members.

11. Privacy and Data Processing

  • Privacy policy: The personal data of members are handled in accordance with the club’s privacy policy.
  • Confidentiality: Members and volunteers who, by virtue of their position, gain access to the personal data of other members are bound by strict confidentiality. They may only use these data for the agreed purpose and must store them securely.
  • Imagery: Every member agrees that photos and video recordings may be made during activities for club channels, unless explicit and motivated objection is made in advance.

12. Amendment of the Internal Regulations

  • Language: These regulations were originally drafted in Dutch. In the event of interpretation differences between the Dutch text and translations thereof, the Dutch text shall always prevail.
  • Amendments: These internal regulations can only be amended in the manner stipulated in the association’s statutes (by a decision of the board). Upon registration, the version that is valid on the website at that time always applies.
